Terms of Service

These Terms of Service ("Terms") govern your access to and use of the SftyFrst mobile application, website, and related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.

If you do not agree to these Terms, do not use the Service.

1. The Service

SftyFrst provides a mobile application and web portal that:

  • Monitors driving behavior through OBD2 vehicle diagnostics and device sensors for all drivers in your household.
  • Generates driving scores, trip reports, and safety alerts for each driver.
  • Produces safety metrics reports based on driving data.
  • Connects household members' accounts for shared safety visibility.

The Service requires a compatible OBD2 Bluetooth (BLE) adapter connected to your vehicle's OBD2 port. SftyFrst does not manufacture or distribute OBD2 adapters — adapters are sourced separately by the user.

2. Eligibility and Accounts

a. Age Requirements

  • Primary account holders: You must be at least 18 years old to create an account.
  • Household members (ages 14–17): A household member account for users aged 14–17 requires verifiable guardian consent and linkage to the primary account. See our Privacy Policy for COPPA compliance details.
  • Under 14: Users under 14 may not create accounts or use the Service.

b. Account Security

  • You are responsible for maintaining the confidentiality of your account credentials.
  • You agree to notify us immediately of any unauthorized access to your account.
  • We reserve the right to suspend accounts that violate these Terms.

c. Account Responsibility

You are responsible for all activity that occurs under your account and credentials, whether or not you authorized it. You must keep your login credentials confidential and must not share access to your account with anyone outside your household. If you believe your account has been compromised, notify us immediately at support@sftyfrst.app. SftyFrst is not liable for losses arising from unauthorized access to your account that you fail to report promptly.

3. Subscription and Payment

a. Free Tier

The Free tier provides limited access to core features, including basic trip tracking with a capped history.

b. Paid Tier

The Advanced tier provides extended access, including increased trip history, detailed safety reports, and advanced driving analytics. Paid tiers are subject to the payment and refund terms described in section 3c.

c. Payment and Refunds

Paid subscriptions automatically renew at the end of each billing period at the then-current price unless cancelled before the renewal date.

You may cancel your subscription at any time. Subscriptions are billed through the SftyFrst website (sftyfrst.app) via Stripe; Apple and Google are not parties to the transaction. To cancel, visit sftyfrst.app/dashboard or contact us at support@sftyfrst.app. Cancellations must be submitted at least 24 hours before the end of the current billing period to take effect for the next cycle, and you retain access until the end of the paid period.

We do not offer partial refunds for unused subscription time. If you believe you were charged in error, contact us at support@sftyfrst.app within 48 hours of the charge and we will review your request.

  • Subscriptions are billed in advance on a monthly or annual basis.
  • We reserve the right to adjust pricing with 30 days' notice to existing subscribers.

4. User Conduct

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws.
  • Reverse-engineer, decompile, or attempt to extract source code from the Service.
  • Access other users' accounts or data without authorization.
  • Interfere with or disrupt the Service, servers, or networks connected to the Service.
  • Use automated tools (bots, scrapers) to access the Service.
  • Share your account credentials with unauthorized parties.

5. Data and Privacy

Your privacy is important to us. Our Privacy Policy describes how we collect, use, store, and protect your data. By using the Service, you consent to the practices described in our Privacy Policy.

Data ownership: You retain ownership of the driving data collected through your account. SftyFrst licenses the right to store, process, and analyze this data solely for providing the Service.

In the event of a data breach affecting your personal information, we will notify affected users via email within 72 hours of becoming aware of the breach, as required by applicable law. Notifications will describe the nature of the breach, data affected, steps taken to address it, and recommended actions for affected users. 6. Third-Party Hardware

  • Adapters: The Service requires a third-party OBD2 adapter. SftyFrst does not manufacture, warranty, or provide technical support for these adapters.
  • Compatibility: Adapter compatibility varies by vehicle make, model, and year. You are responsible for verifying compatibility before purchasing an adapter.
  • Data accuracy: Vehicle diagnostic data is provided by your vehicle's onboard computer through the OBD2 protocol. SftyFrst does not control or guarantee the accuracy of this data.

Active trip recording keeps location services and your OBD2 adapter's Bluetooth connection active for the duration of the trip, which may increase your device's battery and power consumption. SftyFrst is not responsible for battery drain, reduced device performance, or related conditions resulting from active trip recording or adapter use.

7. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

  • We do not warrant that the Service will be uninterrupted, error-free, or secure at all times.
  • We do not warrant that driving scores are accurate indicators of driving safety or safety metrics.
  • We do not warrant that trip data is complete or that all vehicle diagnostics will be captured.
  • Safety disclaimer: SftyFrst is a monitoring and reporting tool, not a safety device. It should not be relied upon as the sole means of ensuring driver safety. Account holders remain responsible for supervising household members who are minors.

8. Limitation of Liability

To the maximum extent permitted by law, SftyFrst and its officers, employees, and affiliates shall not be liable for:

  • Indirect, incidental, special, consequential, or punitive damages.
  • Loss of profits, data, use, goodwill, or other intangible losses.
  • Damages arising from unauthorized access to your account.
  • Damages caused by third-party hardware, vehicles, or third parties.

The total liability of SftyFrst for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Safety Reports

SftyFrst may generate driving reports you may share with third parties at your discretion. These reports:

  • Are based on data collected through the Service and may not reflect all driving activity.
  • Do not guarantee safety improvements or any other outcome.
  • Should be reviewed by you before sharing with any third party.

10. Intellectual Property

The Service, including all content, features, functionality, and underlying code, is owned by SftyFrst and protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes.

11. Termination

  • You may stop using the Service at any time.
  • We may suspend or terminate your account for violation of these Terms, with or without notice.
  • Upon termination, your right to use the Service ceases immediately.
  • Provisions that should survive termination (disclaimers, liability limits, intellectual property) will continue to apply.

12. Changes to These Terms

We may modify these Terms at any time. We will notify users of material changes via in-app notification or email. Continued use of the Service after changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms are governed by the laws of the State of Florida. Any disputes arising from these Terms or your use of the Service shall be resolved in the appropriate courts.

14. Family Plan Restrictions

Household-only usage: Family plans are limited to a single household. Sharing access across multiple households, neighbors, or unrelated parties is prohibited.

Vehicle cap: Family Elite accounts are hard-capped at 12 vehicles. This limit cannot be exceeded under any circumstances.

No commercial use: SftyFrst plans are for personal, non-commercial use only. Use of any plan for commercial fleet management, resale, or business purposes is strictly prohibited.
